Draft Demand Letter & Serve Notice
Once your intake form is completed, Paralegal.NYC™ will draft your demand letter and serve your defendant with demand in accordance with the rules of civil procedure. Your defendant will have 14 days to respond/cure the debt owed before a case will be initiated in court.

Initiate Case in NYC Small Claims Court
​If your defendant does not comply with the demand letter, Paralegal.NYC™ will prepare your Small Claims Summons with Notice and file it with the correct venue based on your intake answers. Here you may gather evidence such as past due invoices, promissory notes, agreements and so forth. After filing your claim, the Small Claims Court clerk will send a notice to the defendant, detailing the court appearance date, your claim, and the amount sought.

Go to Court Prepared
Before your hearing date, collect all evidence that supports your claim or defense. This may include photographs, written agreements, paid bills or invoices, receipts, two or more itemized estimates for services or repairs, canceled checks, damaged items or clothing, and letters or other documents. If you need records not in your possession, consider subpoenaing them for the hearing. For details on this process, refer to Subpoenas.
Additionally, prepare any witnesses who will testify in support of your claim or defense. Testimony from individuals with special or expert knowledge relevant to your case may be crucial to proving your case.
